I've purchased an item in wallapop from the user ByB Z. the item was a wristband for apple watch. The insertion states that the item was as good as new, so we agreed on the price and I purchased it. When I received it I have immediately noticed a defect in the item, in particular an area where the color was different from the rest of the wristband. Not sure whether it was a defect, a damage or another problem, however, it was not as good as new and it should have been advertised as in good conditions instead. The seller took a defensive attitude and, with the excuse of him been victim of a scam in the past, decided not to accept my dispute. Then wallapop investigated the case and, without contacting me, without asking me additional evidence (messages, audio messages, etc.), decided to reject my dispute. I disagree with the decision of rejecting my dispute The item in the insertion was advertised as as good as new, which means without defects. The defect that I've found was not visible in the pictures beforehand cause very difficult to be seen in picture, it could be confused with a light reflection. As soon as I noticed, I contacted the seller and we had a conversation in whatsapp (I used whatsapp because I had to send pictures of the defect to the seller and Wallapop’s chat system doesn’t allow to send attachments) where he admitted the defect and he said he didn't notice it when he put the item for selling. Attached you can see the screenshots of the conversations and I can also forward the audio if necessary. However, he said that in the past he was scammed by somebody returning a different item as part of a devolution and he told me that for that reason he would not have accepted my dispute in wallapop, afraid that I was trying to scam him because, and I quote, he didn't know me and didn't trust me. This is absolutely unfair, he rejected my dispute not because he doesn't agree the product was defected, but because he wanted to protect himself from a possible scam due to his past experience. The fact that Wallapop decided to reject my dispute without getting in contact with me (or the seller) to obtain additional information is absolutely unacceptable. This is resulting on me buying something sold as good as knew and receiving something with a defect, hence I am victim of a scam, and given the decision of rejecting my dispute I consider Wallapop to have a responsibility. I asked Wallapop to reopen this dispute and reconsider the decision after reviewing the evidence of my conversation with the seller. However, Wallapop did not request me to submit the messages (that I am attaching here) nor asked me additional information. They simply replied that the reason I wanted to return the item is not considered valid in their return policy. So, if users buy something advertised as perfect and it comes with a defect, Wallapop does not protect and people get scammed. For this reason I strongly advise to avoid this platform.
