Dear Sir/Madam,
On 25 November 2025, I placed an order for a refurbished Apple Watch Ultra 2 through your online store K-tuin, under order number 101358393.
The shipment was supposed to be delivered from Spain to the following address:

Spain
To this day, I have not received the product.
I would like to emphasize that I formally contacted you 14 days ago regarding this matter and granted you a reasonable period to resolve the issue.
No action has been taken and no satisfactory solution has been provided to date.
Under Spanish Consumer Law (Ley General para la Defensa de los Consumidores y Usuarios, Real Decreto Legislativo 1/2007), specifically Articles 66 bis, 118 and following, you as the seller are fully responsible for correct and timely delivery. As long as the product has not been physically delivered to the consumer, all risk and responsibility remain with the seller.
I must also express my serious dissatisfaction and my feeling of having been significantly disadvantaged by the lack of any concrete solution. Continuing to state that the order has been delivered without valid proof of correct delivery creates an unacceptable situation and seriously undermines my trust as a consumer.
By means of this letter, I hereby formally place you in default once again and request that, within 2 days from the date of this notice, you do one of the following:
Provide a replacement Apple Watch Ultra 2 free of charge,
or
Issue an immediate full refund of the purchase amount.
If no satisfactory solution is provided within this period, I will proceed without further notice to:
– File a formal complaint with the European Consumer Centre (ECC-Net), and take further steps if necessary.
I kindly request that you resolve this matter without further delay and keep me informed of the progress.
