Recientemente he viajado utilizando la compañía airBaltic desde Barcelona a Riga. En el momento de facturar el equipaje, la aerolínea nos comenta que como no hemos hecho la facturación online, nos tienen que cobrar una tasa de 70 EUR (35 EUR por persona), lo cual es totalmente abusivo y fuera de base legal de la legislación española como ya fue fijado en varias ocasiones por el juzgado de lo Mercantil de Madrid - Sentencia del 22 de octubre de 2016 del Juzgado de lo Mercantil número 6 de Madrid.Esto es una grave vulneración del derecho de los consumidores, ya que nos dijeron que no habrá tarjetas de embarque sin pagar, y por tanto no habrá embarque. Básicamente nos estaban denegando el embarque si no pagábamos, y en base a las normas de AESA, el embarque sólo debe denegarse cuando existan razones de fuerza mayor para ello, y no hacer la facturación online no es una de esas razones.Me he puesto en contacto directamente con airBaltic y como su respuesta es Esos son nuestros términos y condiciones estoy emprendiendo nuevas acciones legales empezando por aquí.

Dear Sirs,With reference to your request, Air Baltic Corporation AS (Airline) hereby informs you that it had received a claim from Passenger regarding airport check-in before the flight BT684 on the route Barcelona - Riga on December 10th, 2023.Airline would like to explain that according to its General conditions of carriage Article 6.4. (which Passenger has accepted while purchasing ticket on Airline's webpage) for check-in at the airport, a charge may be applied for this service. Currently the charge is EUR 35 per passengers. Additionally, this information about the applicable fee (see attached the sent e-mail visualization) was sent according to our system data to Passenger's e-mail address at 3:06 on December 9th, 2023 and was opened by Passenger at 3:45 on December 9th, 2023. Dear Toms,Thank you for your answer. Unfortunatelly, I must insist in the nature of my claim. Airlines can’t apply airport check-in fee due to court dictamination as I explained in my previuos messages and emails regarding this topic, since it has been declared abusive and out of proportion. It also applies to airBaltic.Additionally, I would like to point out that even when those conditions are informed they are still out of legal basis, just because your are announcing that you will be applying extra charges (unilaterally), does not make it legal, based on AESA rules. This is a violation of consumers right.In addition, opening an email does not mean that the information is received, I wouldn’t be writing you here if I would have get the information correctly.I have already taken further actions due to the lack of solution from your side and I will led it to the hands of the European Consumer Rights Center.Kind regards.

Dear Sirs,With reference to your repeated letter, I would like to inform you that in my previous e-mail I gave you an explanation about our position regarding reimbursement of expenses. I am sorry to hear that you do not agree with the explanation given and our decision on the refusal of the refund, however currently we do not have the grounds to revise our decision.
