We refer to your recent correspondence relating to the customer Mrs. CARMEN VADILLO
On behalf of Ryanair, we sincerely regret the delay of flight FR5730 from AGP-PMI was delayed due to restrictions of the airspace imposed by air traffic control services, outside of the control of Ryanair.
Some National Enforcement Bodies appear to believe that ATC slots are to be considered within the airline’s inherent and normal activity but we think the Regulation EU261 is quite clear on clause 15. The airline has no other choice but to comply with an ATC slot.
EU261 requires airlines to provide the Article 14.2 notice at check-in and to distribute it during flight disruptions. In order to comply with EU261 Ryanair has provided the Article 14.2 notice when customers check in online. This gives ample opportunity prior to departure to review and have access to the notice of their rights at all times.
All customers affected by this flightcancellationwere sent an email and SMS giving customers access to the EU261 notice.
As thisdelay was completely outside of Ryanair’s control, we regret to advise that no monetary compensation is due under EU Regulation 261/2004.
