Retraso en el vuelo de Ryanair

El día 13 de mayo del 2023, mis amigas y yo compramos los billetes Valencia-Edimburgo (FR1093) para el día 26 de agosto a las 13:50h (hora de España) con un coste de 151.49€/persona y los billetes Edimburgo-Valencia (FR1092) para el día 2 de septiembre a las 9:25h (hora de Reino Unido) con un coste de 220.89€/persona (total de 5 personas: 1861.88€).El 2 de septiembre llegamos al aeropuerto de Edimburgo sobre las 7:10h para facturar y pasar los controles de seguridad con tiempo. Al poco de estar allí, se anunció un retraso en el vuelo de unos 30 minutos y enseguida se volvió anunciar que el vuelo se retrasaba hasta las 11:25h. Por la aplicación móvil se avisó que el retraso estaba causado por un fallo técnico menor (lástima que no tenga una captura de pantalla del aviso porque desapareció) y se ofreció un descuento de 3 libras para bebida y comida (bastante justo de dinero porque eso no costaba ni un sandwich envasado). Finalmente, la salida del vuelo se retrasó hasta las 11:50h. A las 12:00h estábamos en el avión y estuvimos esperando durante 1 hora más allí, sin ninguna explicación (aunque preguntamos al personal de cabina a qué se debían todos los retrasos y no nos contestaron). Además, poco antes de por fin despegar, empezó a oler a combustible y dimos por hecho que estaban repostando (el problema es que, por curiosidad hemos investigado si eso está permitido y resulta que se debe avisar al pasaje del repostaje para que estén avisados [no hubo ningún aviso], estén con el cinturón de seguridad desabrochado [puedo asegurar que parte de los pasajeros lo llevábamos puesto porque éramos unas de ellos] y que no vaya nadie al baño [había cola hasta para entrar], entre otras cosas). Al final, el avión despegó prácticamente a las 13:00h (hora de Reino Unido) y aterrizamos en Valencia a las 16:50h (hora de España).Cuando un par de días después reclamamos a Ryanair por el retraso de más de 3 horas, nos contestaron que no teníamos derecho a una compensación porque el retraso se debió al mal tiempo (¿no era debido a un fallo técnico menor?). Hemos revisado imágenes de radar de vuelos de ese día y a la supuesta hora de despegue del vuelo (las 9:25h) despegaban y aterrizaban vuelos tanto del aeropuerto de Edimburgo como del de Valencia (si hubiera condiciones climatológicas adversas afectaría a todos los vuelos, ¿no?). Además, el avión que tenía que realizar el trayecto se encontraba en ese momento en Nimes aterrizando, así que era imposible que a las 9:25h pudiera estar despegando de Edimburgo.Una copia de esta reclamación se ha presentado a la empresa (Ryanair) a través del portal de resolución de litigios en línea de la Comisión Europea.

Hola Gonzalo,Muchas gracias por los datos del METAR sin ninguna explicación de todas las letras y números que estaba viendo, aunque nada que una búsqueda de Google no pueda solucionar. Entiendo que el avión que teníamos que coger desde Edimburgo se retrasara porque en el destino previo había niebla y, como no se podía realizar el aterrizaje, se desviara a otro aeropuerto cercano. He buscado la ruta de dicho vuelo (lo aporto en el archivo adjunto) y, a pesar de estar en el aire dando vueltas hasta que la tripulación decidió aterrizar en otro aeropuerto, el avión llegó a Shannon (Irlanda) a las 8:17 horas. Me he permitido también buscar cuánto tarda un avión en hacer la ruta Shannon-Edimburgo (está también en el archivo adjunto) y en 1 hora y 15 minutos habría llegado el avión a Edimburgo, prácticamente a la hora a la que estaba prevista el despegue de mi vuelo. Aún teniendo que esperar a que los pasajeros bajasen en el aeropuerto de Shannon y a que la tripulación hiciese las comprobaciones necesarias en el avión, ese aparato habría llegado antes a Edimburgo de lo que lo hizo el avión que finalmente cogimos. Por lo tanto, lo que me has dicho de "Ryanair efectuó un cambio de aeronave lo antes posible con el finde disminuir las molestiascausadas por el desvío" me resulta un tanto extraño y no me justifica tanto retraso como hubo, ya que en los mensajes que enviaba Ryanair indicaba fallo técnico menor y no condiciones climáticas adversas. Además, a ese retraso se suma la hora que estuvimos esperando ya subidos en el avión mientras se cargaba combustible (sin avisar a los pasajeros) y esperábamos por fin a poder despegar no creo que esta hora adicional sea a causa de la niebla en Irlanda...Mis amigas y yo seguimos exigiendo que se cumpla el Reglamento (CE) nº 261/2004 y se nos indemnice con la cantidad correspondiente.
