Equipaje de mano cobrado en facturación

El pasado 22 de agosto realicé un vuelo Barcelona-Budapest en el que me fue facturado por Ryanair la cantidad de 46 eur por el equipaje de mano (maleta pequeña). En España, la Ley de Navegación Aérea (que data de 1960) establece en el artículo 97 que el transportista "estará obligado a transportar juntamente con los viajeros, y dentro del precio del billete, el equipaje con los límites de peso, independientemente del número de bultos, y volumen que fijen los Reglamentos". Según sentencia este cobro es abusivo 787/2022 y procedo a la reclamación pertinente. Adjunto billete, pago del mismo y cobro de los 46 eur extras por la maleta.

Adjunto imágenes para que se observe el tamaño de la maleta de mano, que cupo en el portaequipajes superior del avión sin ningún problema.

Buenos días, Como podrás leer en la página oficinal del Gobierno de España, AESA: https://www.seguridadaerea.gob.es/es/ambitos/derechos-de-los-pasajeros/otras-incidencias/equipajes#:~:text=Por%20su%20parte%20el%20art%C3%ADculo,que%20el%20viajero%20lleve%20consigo. El transportista estará obligado a transportar de forma gratuita en cabina, como equipaje de mano, los objetos y bultos que el viajero lleve consigo. Por ejemplo, la Asociación de Transporte Aéreo Internacional (IATA) recomienda que el equipaje de mano no supere las dimensiones de 56 cm x 45 cm x 25 cm. No se midió la maleta, pues esta cumple con las medidas que Udes y AESA indican. Simplemente, cómo no había abonado previamente la tasa, se me facturó allí sin ton ni son. Hay cámaras en el aeropuerto, pueden comprobarlo. No hubo medición alguna, llegué a facturación y me pusieron a un lado para que un compañero me cobrara. Saben perfectamente que entran mochilas mucho más grandes que mi maleta, que además, entra en los parámetros que udes estipulan. Me remito a la sentencia 787/2022 a favor del usuario por cobro abusivo. En ese momento o pagas o no subes al avión, sirva la presente para valorar de nuevo la reclamación o iremos por otras vías.
