Devolución por cambio sustancial.

Hola. Adquirí dos entradas para el festival Bigsound Valencia 2026. He solicitado la devolución del importe de las dos entradas, complementos y gastos de gestión por cambio sustancial del evento. Han cambiado la ubicación de las Artes y más ciencias de valencia a un parque en Torrent. Cambio de municipio. Molestia y dificultad de acudir a la nueva ubicación. Cambio de un lugar emblemático a otro sin ningún atractivo. Les he retirado en múltiples ocasiones que me quiero acoger a mi derecho de devolución. Su respuesta: ¡Hola! Sentimos que tu experiencia no hay sido positiva. Te informamos de que las condiciones de las entradas y del evento las establece la empresa promotora del evento. Enterticket actúa únicamente como distribuidora de entradas. Como consecuencia de una resolución judicial en contra del Ayuntamiento de Valencia, el festival no ha sido cancelado, sino trasladado para poder celebrarse en las condiciones adecuadas sin modificaciones sustanciales. Al mantener los días, los artistas, los horarios anunciados y la esencia del festival, las entradas continúan siendo válidas para el evento. Un saludo y sentimos las molestias. Respuesta de enterticket: --------------------------------------------------------------- Ante la notificación recibida por este Organismo con el propósito de presentar nuestra defensa, dando traslado conferido sobre la base de las siguientes: En primer lugar, en relación con la reclamación de referencia y con el objetivo de dar contexto a este Organismo, cabe indicar que Enterticket únicamente es la titular de la plataforma de venta de entradas para conciertos, festivales o eventos organizados por terceros promotores, como ocurre en este caso. Que el servicio prestado por Enterticket consiste exclusivamente en actuar como plataforma tecnológica de intermediación, poniendo a disposición de los promotores y de los usuarios/asistentes, su portal web con sus sistemas de venta de entradas, con la finalidad de facilitar la distribución y venta de entradas al público para conciertos y eventos organizados y gestionados por los Promotores. En particular, Enterticket se limita a: • interconectar a los usuarios/asistentes con los Promotores, • gestionar el proceso de compra y emisión de la entrada electrónica (o física, cuando proceda), • y facilitar el acceso al evento mediante un proceso de verificación de entradas y control de acceso eficiente y seguro. En cualquier caso, Enterticket no participa en la organización, producción, gestión, ejecución o control del evento, ni asume responsabilidad alguna sobre su celebración, desarrollo, contenido, condiciones de acceso, seguridad, cancelación o modificación, siendo dichas responsabilidades asumidas íntegramente por el Promotor. Por tanto, son los promotores los responsables de la gestión de cuanto acontece a los mismos, bien sea debido a cambios de localización, de artistas, del horario y duración del espectáculo y, en definitiva, de las devoluciones y/o reembolsos que pudieran corresponder a los asistentes. Que, como ha quedado demostrado, Enterticket se limita a ser la titular de la página web que pone en contacto, por medio de su plataforma, a los promotores / organizadores de los eventos anunciados en www.enterticket.com, con aquellos usuarios que adquieren entradas para asistir a los mismos, limitándose a proporcionar la información que el organizador del evento le traslada con respecto a lo indispensable por normativa. Entre tanto, el lugar de celebración del espectáculo, la fecha y hora, precio de las localidades, etc. Que los Promotores son los responsables de sus eventos y de cumplir con la normativa de espectáculos que le sea de aplicación en su Comunidad Autónoma. Así, siendo responsabilidad única del Promotor y de la organización del evento dar las explicaciones oportunas y actuar según los deberes y obligaciones de la normativa de aplicación, tal y como el propio Reclamante expresa en su escrito, la reclamación solo puede dirigirse frente a la sociedad promotora (BIGSOUND FESTIVAL VLC, SL) con NIF (B40644262). Que, además, Enterticket no intermedia en la recaudación del dinero de las entradas, por lo que se encuentra imposibilitado para ejecutar las devoluciones, modificaciones en entradas y condiciones del evento. Por todo lo expuesto, SOLICITAMOS que, teniendo por presentado este escrito, lo admita, tenga por atendida la notificación recibida y, en consecuencia, ordene el archivo del expediente al no corresponder a esta parte su gestión, sino a la promotora del evento. ------------------------------------------------------------------------------------------------------ Al haber sido Enterticket quien me ha cobrado el total del importe solito que seáis vosotros quien me lo tenéis que devolver. Lo que solito simplemente es cumplir con la ley y dejar de tratar de desgastar al usuario en un juego a 3 bandas. Por tanto vuelvo a solicitar la devolución de todo el dinero pagado.
