OCU complaint to the Bank of Spain to withdraw cash commission in Spain and abroad
18 feb. 2016Similarly, OCU has denounced the Spanish banks by the high and unjustified fees charged to withdraw cash in other European countries, something that clearly violates the law.
OCU has filed this complaint with the financial supervisor, as a result of widespread application of kickbacks for using ATMs in other EU countries, and the implementation of the long famous as maligned commission of up to two euros to users withdraw cash in national ATM. OCU understands that there has been no mandatory notice, in writing, two months showing that OCU considered illegal; besides absolutely unjustified and not covered in the corresponding cost to the service actually provided.
OCU believes that entities widely violate Article 22.1 of Law 16/2009 of payment services, by applying to users new cash withdrawal fees at various ATMs, no formal communication, individually and on paper or another durable medium, with two months' notice.
Therefore, OCU calls for immediate repayment of the charges unduly paid by the institutions.
Furthermore, OCU appreciated abuse vulnerability and operations cash withdrawals of third countries in the EU. OCU recalls that Regulation 924/2009 on cross-border payments in euros implies that the maximum fee that may be charged by institutions to their customers when they use an ATM in another country in the euro area can not be higher than that applied in Spain . These fees are always a percentage of the amount extracted with minimal. Furthermore, these percentages tend to be high and are around 4% of the amount, with minimum excess of 4 euros. OCU considered unacceptable this mismatch, one in a policy of widespread abuses against consumers by Spanish banks.
