OCU alarmed with the content of real decree on clause filtered ground

Regarding information published today in different media, where the content of the Royal Decree has been advanced and will be presented tomorrow in Congress for approval, OCU warns that, if the text is true, this new norm would be a clear detriment to consumers.

 According to the information leaked, the banks would be the only beneficiaries of this new Royal Decree, which aims to establish a new extrajudicial system to return the amounts overpaid in the land clauses following the ruling of the Court of Justice of the European Union.

OCU remembers that the entities must return all the amounts overpaid from the beginning of the contract, plus the corresponding interest of delay. Any agreement that does not respect this obligation is not acceptable.

OCU considers that financial institutions, as stakeholders, should not be responsible for calculating overpaid amounts. Consumers in general do not have the knowledge and means to verify such calculations, so they could end up signing agreements without knowing if the calculations are correct.

OCU criticizes the special regime of legal costs that is expected to be established, since it favors financial institutions in particular and practically obliges the consumer to go to extrajudicial proceedings, in theory, voluntarily.

Finally OCU does not understand that the decree talks about establishing free of charge for the parties of the tariffs, notarial and registry in the agreements reached, when in any case it is necessary to modify the contracts to proceed with the return of the amounts collected of more.
