OCU applauds Bankia's offer but suggests customers check amounts before accepting
30 ene. 2017Bankia today announced the launch of an express procedure so that consumers affected by the clause soil can request the refund of overpaid amounts. According to the entity, the return can be requested starting next Friday February 3 by going to your office of Bankia and filling an application.
OCU warns those affected that there may be cases where Bankia does not automatically return the money. According to available information, only in the event that Bankia believes that the client is right and that the clause is abusive, will make an offer. This offer would include the refund of the amounts overpaid, along with the legal interest of the money, which according to Bankia will be the same amount that could potentially achieve with a favorable judicial ruling.
In addition, according to the information given by Bankia, the option to collect in cash or amortize part of the outstanding capital of your mortgage will be offered.
OCU recommends that, before signing anything, check the amounts that they offer to know if they match what you have overpaid. For this purpose OCU makes available to all consumers a free calculator so that they can verify the amounts due by the floor clause: http://www.ocu.org/dinero/hipotecas/calculadora/calcula-clausulas-suelo
Remember also that the bank must recalculate the outstanding capital. Since, having paid more interest than it was entitled to, the capital that has been repaid has been lower, so the capital to be repaid, that is, the amount owed to the bank, is greater than that which would correspond to it If there had been no floor clause.
In OCU's opinion Bankia has simply launched the government-approved out-of-court claim system. From OCU we value positively the initiative and agility of Bankia, that also supposes the recognition of the abuse of the clause soil of its contracts.
OCU demands that Bankia does not leave any affected consumers out of the procedure and that all their clients can recover the money due. OCU also expects other entities to follow the same steps and not force their clients to start legal proceedings to recover their money.
