OCU requires Air Europa ensure minimum services and respect the rights of passengers

22 jul. 2016

The pilots of Air Europa will begin next week from Saturday July 30 to Tuesday August 2, a strike in protest against the worsening of their working conditions, following the announcement by the company of a new line of low cost week , Aeronova. The planned four-day strike coincides with the day's passenger traffic in summer and therefore affect large numbers of tourists who begin or end their holidays at this time.

Unfortunately since the strike on July 8 announced so far has not reached an agreement that allows cancel demonstrations planned. OCU is concerned about the impact of the strike on consumers.

OCU requires that it is necessary to ensure compliance with scheduled flights and the payment of compensation established by the regulations for passengers who may be affected by delays or cancellations action.

The strike called not considered a force majeure, therefore, if there is any harm to the consumer, OCU advises consumers affected claim and demand compensation established by the regulations.

OCU reminds all passengers suffer in the case of cancellation or long delay (more than five hours) have first right to choose between making the journey or refund of the ticket within seven days. Moreover, for any delay of more than three hours they are entitled to the same compensation set by the European regulation for flight cancellations. Passengers affected can check the amount you are entitled to compensation calculator available to all users. OCU recalls that those affected are also entitled to a return flight from the point where the journey is interrupted or be transported to their destination by alternative transport means quickly as possible.

Also, passengers are entitled after a delay of two to four hours, depending on the distance, assistance by the company to provide them with food, drink, communications and accommodation if necessary. Regardless of the above, if the consumer can prove any damage beyond these compensations are also entitled to be indemnified, for that you must keep all tickets and invoices to justify the damage.

OCU recommends affected passengers claiming in writing at the counters of the company, if not possible to do so through the complaint forms AENA available at all airports. In addition, it is advisable to keep the supporting documentation for all expenses that the performance of the company may have caused them (transport, food, loss reserves, etc).

From OCU emphasizes the need to regulate definitively the exercise of the right to strike in essential services so that respect and can exercise their constitutional right to strike and the right to guarantee mobility, as happens in many countries in our environment.
